You settle for $50,000 and picture that number landing in your account.

That's not how it works.

Before you see a dime, your settlement runs through a payment line. Attorney fees and case costs come out first. If Medicare or Medicaid paid any of your medical bills, federal law gives them priority repayment next. After that, your own health insurer can step in too.

This is called subrogation. If your health plan paid your bills after the accident, it has the legal right to be reimbursed from your settlement, so you're not paid twice for the same expenses. Hospitals can do something similar through a medical lien if you were treated without insurance.

Here's the part most people miss: liens are negotiable. Medical provider liens are frequently reduced through negotiation, and health insurance subrogation claims can sometimes be lowered too, especially when your settlement doesn't fully cover everything you lost.

The bottom line is this: the number in your settlement letter and the number that hits your account are rarely the same one.
