Your Intent to File Is Not Your Claim

Veterans hear "Intent to File" and think they've already started their claim.

They haven't. And the gap between the two can cost thousands of dollars.

An Intent to File — VA Form 21-0966 — is a five-minute notice that tells the VA one thing: you plan to file a claim. It doesn't require medical evidence, doesn't get you an exam, and doesn't put a rater anywhere near your case. What it does is lock in a potential effective date — the date your back pay starts counting from if your claim is eventually approved.

Here's why that date matters so much. Back pay is calculated from your effective date forward to your decision date, at whatever rate your final rating works out to. Without an Intent to File on record, that effective date is simply whenever your completed claim actually lands at the VA — meaning every month spent gathering records, waiting on a private nexus letter, or building your evidence file is a month of back pay you never get.

Filing the Intent to File first changes that. Your effective date locks in the day the VA receives it, and you get a full year to submit the completed claim while your back pay clock is already running.

One year, not more. If that window closes before you file the actual claim, the Intent to File expires completely, and your effective date resets to whenever you finally submit. There are no extensions.

Three ways to file it: online at VA.gov, by phone at 1-800-827-1000, or by mail on the paper form to the VA Claims Intake Center. If you start your disability claim application online at VA.gov and simply save your progress, the VA automatically records that as your Intent to File — you don't need a separate form.

The bottom line is this: the Intent to File isn't the claim, it's the thing that protects your back pay while you build the claim. If you're even considering filing, that five-minute form should be the first thing you do, not the last.
